New Program Requirementsfor the IHSS Programs
Implementation of Overtime, Travel Time and Wait Time

February 2016, the new Fair Labor Standards Act (FLSA) Overtime, Travel Time and WaitTimerequirements beganin the IHSS Program. To ensure as smooth an implementation of these changes as possible, we hope to provide all information pertaining to the changes, and for counties and Public Authorities,the County/Public Authority (PA) Training Plan.

IHSS Provider Overtime Exemption and Violation Statistics

  • Exemption 1: As of 9/13/2016, there were 1,230 providers approved, 459 denied, and 56 pending approval for the Parent Provider exemption.
  • Exemption 2: As of 9/13/2016, there were 34 providers approved, 45 denied, and 5 pending approval for the Extraordinary Circumstances exemption.

IHSS Overtime Exemption 2

The Departmentdeveloped an Extraordinary Circumstances Exemption (Exemption 2) for providers who serve two or more recipients who meet one or more conditions to allow them to work up to 360 hours per month, up to 90 hours per week combined for all recipients, and not receive a workweek violation.
