About Delegation Documents

Four delegation documents are important to the public assistance hearings handled by the State Hearings Division (SHD) of the California Department of Social Services (CDSS).

Note: A delegation document is a legal document which delegates specified authority or power(s) to a named individual as identified in the delegation document.

The four delegation documents are as follows:

CDHS Hearing Authority

This delegation document, signed by the Director of the California Department of Health Services (CDHS), appoints the Director of the California Department of Social Services (CDSS) as the hearing authority to hear and decide cases pursuant to Welfare and Institutions Code (W&IC) §10950 for the CDHS and delegates to her the authority and power to:

  • adopt decisions in all cases except as specified
  • grant or deny rehearing requests on cases dismissed due to nonappearance
  • delegate authority to subordinates in writing

CDSS Hearing Authority

This delegation document, signed by the Director of the California Department of Social Services (CDSS), appoints the Chief Administrative Law Judge of the State Hearings Division (SHD) as the hearing authority to hear and decide cases pursuant to Welfare and Institutions Code (W&IC) §10950 for the CDSS and the CDHS and delegates to him the authority and power to:

  • act on proposed decisions pursuant to W&IC §10959, including adopting proposed decisions, issuing Director’s alternate decisions, and ordering further hearings
  • grant or deny rehearing requests on cases dismissed due to nonappearance
  • delegate to all CDSS Administrative Law Judges (I and II) the power to adopt final decisions pursuant to W&IC §10966
  • delegate to all CDSS Administrative Law Judges IIs the power to act on proposed decisions pursuant to W&IC §10959, including adopting proposed decisions, issuing Director’s alternate decisions, and ordering further hearings

Final Decisions

This delegation document, signed by the Chief Administrative Law Judge, delegates to the named Administrative Law Judge the power to adopt final decisions pursuant to W&IC §10966 for the CDSS and the CDHS in all cases except as specified.

Proposed Decisions

This delegation document, signed by the Chief Administrative Law Judge, delegates to the named Administrative Law Judge II (Presiding Judges and ALJ Specialists) the power to act on proposed decisions pursuant to W&IC §10959 for the CDSS and the CDHS. This includes the power to adopt proposed decisions in all cases except as specified, issue Director’s alternate decisions, and order further hearings.
