Tyler v. Anderson Settlement Agreement

Tyler v. Anderson is a class action lawsuit filed in 1993. The case involves the CDSS policy of denying range of motion exercises to IHSS recipients from June 17, 1990 through March 31, 1993.

The settlement agreement extends the period for which claims may be filed to March 31, 1994. The settlement agreement was approved by the Sacramento Superior Court in a judgment on January 22, 1999. It applies to applicants, recipients and providers who were denied services or payment for range of motion exercises during the time period at issue. The counties of Amador, Calaveras, Fresno, Los Angeles, San Bernardino, and Tehama are exempted from this lawsuit because they continued to provide range of motion exercises during this time period.

Under the terms of the settlement agreement, class members must be notified and are then given a six-month time period to file a claim. Claimants who file a valid claim will receive retroactive payments with interest.

The CDSS has established a new unit that will process the Tyler claims. The CDSS will thus be the party in a state hearing should a claimant request a hearing on a Tyler issue.
