Kehrer v. Saenz Court Order

Child support payments from the absent parent of a Maximum Family Grant (MFG) child, whether paid directly to the aided family or to the District Attorney are exempt from consideration as income in CalWORKs cases subject to the MFG rule. Also, derivative benefits from Social Security or other government benefit based on the absent parent's disability or retirement and paid to or on behalf of an MFG child are exempt if they satisfy some or all of the absent parent's child support obligation.

Prior to Kehrer, CDSS did not exempt such income. These changes became effective with April 1, 2001 grant payments and eligibility determinations. MPP §44-314.62 was modified effective July 1, 2001 to reflect these changes.

While the regulation is effective July 1, the policy is effective April 1.
