Revisions to IPV Hearings Process Form

DPA 479 (ADH Waiver – CalWORKs/FS)

The DPA 479 has been changed as follows:

The length of the possible penalty periods has been changed in Paragraph One.

The bullet in Paragraph Three, beginning "For Food Stamps Only" has been changed to reflect the fact that since December 1996, there is no earned income deduction allowable both in the IPV and the non-Administrative Error situations when information is not reported.

The Respondent is advised that if he/she does not sign the waiver, nor attend the hearing, the Respondent may still wish to submit a statement for inclusion in the record.

The Disqualification penalties have been clarified and set forth in their entirety, on the top of page 2.

The CDSS will no longer automatically insert a county representative’s name in the last paragraph of the form. The county will identify and then provide the name and phone number of the contact person to the State Hearings Division’s ADH coordinator so that the correct county representative information will be given.

The word "calendar" has been added to describe the length of time the respondent has to return the signed waiver.
