ADH -- New Penalties in AFDC IPVs

Effective October 5, 1995, MPP §20-353.2 provides for increased penalties for AFDC IPVs as follows:

.2 Individuals found to have committed an IPV either through an ADH or by a court of appropriate jurisdiction, based upon submitting more than one application for the same period of time and for the purpose of receiving more than one grant of aid,

or

for submitting documents for nonexistent children, or submitting false documents for the purpose of showing ineligible children to be eligible for aid, shall be ineligible to receive AFDC benefits as follows:

.21 Two years for the first violation.

.22 Four years for the second violation.

.23 Permanently for the third violation.

Subsection 20-353.3 notes that the above penalties do not apply to those applicants and recipients who are designated as members of the California Work Pays Demonstration Project control group.

Applicable state forms are being revised to reflect the new penalty provisions.
