| Item 96-12-02A CDHS ACWDL 96-53 -- September 17, 1996 (Synopsis): Citizen/Immigration Status Declaration and Social Security Number Requirements |
The CDHS issued ACWDL 96-34 instructing counties how to implement citizenship/immigrant status declaration and Social Security number requirements pursuant to Crespin v. Coye (1994) 27 Cal.App.4th 700. This ACL supersedes 96-34. The date for implementation was moved from September 1, 1996 to October 1, 1996.
Effective October 1, 1996:
Every person requesting Medi-Cal is required to provide information about his or her citizenship/immigration status by completing the MC 13 form.
Every person requesting Medi-Cal who has a Social Security number at the time of application is asked to provide it regardless of immigration status. However, aliens eligible for restricted Medi-Cal benefits only are not required to provide a Social Security number as a condition of eligibility.
Medi-Cal applicants no longer request full or restricted Medi-Cal benefits. County welfare departments will determine the level of benefits an applicant is potentially eligible to receive based on citizenship/immigration status information.
