California Code of Regulations (CCR) §50461 regarding motor vehicles has been amended to conform with McKnight v. McMahon, a case involving valuation of motor vehicles in AFDC, issued in 1992.
Effective April 6, 1992, one motor vehicle is exempt for Medi-Cal purposes regardless of whether it is used for transportation. Any references to "used for transportation" are deleted from §50461.
Applicants or recipients no longer are required to provide three appraisals if they disagree with the net market value determined by the county using the Department of Motor Vehicle (DMV) license fee chart. Alternatives to using the DMV license fee chart to determine the value of a motor vehicle include:
A) The Kelley Blue Book wholesale value.
B) The market value determined by the National Auto Dealers Association.
C) An estimate of market value obtained by the applicant or beneficiary from a disinterested knowledgeable source.
