Item 96-12-03D
Decisions -- Recommended Language if Order includes: "as otherwise eligible"

If the Order in a released decision includes the phrase "as otherwise eligible," a CDSS judge should include the following language as the last paragraph in his/her Conclusion (do not include in Order):

After receiving this decision, the county may ask the claimant(s) in writing to provide information essential to the eligibility determination required by this decision. The claimant(s) is advised to promptly provide all requested essential information to the county to assure the county is able to comply with this decision.

AAD designed the above language to encourage claimant(s) to promptly provide requested essential information so counties may comply with decisions.

Refer to All-County Appeals Staff letter issued September 23, 1996, which describes county responsibilities regarding decision compliance.
