Counties are not required to immediately determine compliance with the ABAWD work requirement. A county may wait until recertification to determine whether a recipient has satisfied the ABAWD work requirement.
Effective November 6, 1997, MPP §63-410.45 stating that an overissuance occurs when an individual has received food stamps beyond three months without meeting the ABAWD work requirement has been repealed. Thus, if an ABAWD received food stamp benefits for more than three months without meeting the ABAWD work requirement, the county at recertification may discontinue food stamps if the individual still does not meet the ABAWD work requirement nor is exempt from such requirements. The county may not charge the individual with an overissuance for failing to meet such requirement for more than three months.
