| Item 98-04-01E CDSS ACL 98-16 -- March 9, 1998 (Synopsis): Food Stamp Disqualification for Drug Felons |
MPP §63-402.229 effective September 1, 1997 as currently written states that an individual convicted of a drug felony (i.e. possession, use, or distribution) is permanently disqualified from the Food Stamp program if the conviction occurred after August 22, 1996.
This ACL advises that per Public Law No. 105-33, a convicted drug felon is permanently disqualified for conduct occurring after August 22, 1996. Thus a person who committed a drug felony before August 22, 1996, but who was convicted after August 22, 1996, would be eligible for food stamp benefits if such person meets other Food Stamp eligibility criteria.
