In ACL 97-55, counties were directed to cease seeking recovery of non-fraudulent foster care overpayments from relative and licensed family homes. That ACL also directed counties to notify all relative and licensed family homes (including homes of non-related legal guardians) subject to overpayment recovery actions of the rescission of such actions.
On March 17, 1998, the Bass court issued an order setting forth terms for retroactive relief and requiring CDSS to instruct counties on how to proceed. The counties sent out claim forms to potential Bass class members. This ACL explains how the counties are to proceed on claims for retroactive relief under the Bass case.
The class members for purposes of retroactive relief consists of:
all relative foster care providers, non-related legal guardians and licensed foster family homes who provided foster care services to a child or children placed in their care AND
received non-fraudulent foster care overpayments AND
who on or after April 1, 1992, were assessed such overpayments by a county AND
who reimbursed the county for such an assessed overpayment.
