The GAIN program regulations in effect on December 31, 1997 remained in effect in each county until the new WtW requirements became operative in a county. Once a county begins to implement its WtW plan, the previous GAIN program ceases to exist. Any prior sanction in the GAIN program in effect prior to the county implementation of WtW should not be considered. As a result, the first time a CalWORKs recipient fails to participate in WtW and is sanctioned for such failure, he/she is subject to a first instance sanction even if he/she had a previous GAIN sanction.
