FS Questions and Answers on General Issues and Employment Issues
Nonemployment Issues
- Per MPP §63-405.413, all quarters earned by a noncitizen parent prior to the birth or
arrival in the United States can be credited through the quarter the noncitizen
attains age 18.
- When an excluded household member fits into two income and/or resource categories, the
stricter treatment of income and/or resources is used. This ACIN provides a chart
describing which income or resources to use when an excluded household member is in more
than one category of exclusion. The chart is divided into four categories; ineligible
non-citizens, Social Security Number disqualified people, ineligible students, and
ineligible ABAWDs
Employment Issues
- Counties should be sending out a Notice of Action discontinuing FS benefits to an ABAWD
in the third month that the ABAWD fails to meet (or be exempt from) the ABAWD requirement.
If the county fails to issue the discontinuance notice timely and the ABAWD receives FS
benefits for more than three months without meeting or being exempt from the ABAWD work
requirement, there is an overissuance.
- If a CalWORKs recipient signs a WtW compliance plan within 20 days after receiving a
CalWORKs notice advising of a sanction, per MPP §42-721.27, the sanction is rescinded.
Therefore, a FS sanction should also not be imposed. When a participant fails to meet the
terms of the compliance plan without good cause, both CalWORKs and FS sanctions are
imposed. However, the county must issue a new Notice of Action for each program before
imposing such sanctions. See MPP §42-721.29 for CalWORKs and §63-407.541 for food
stamps.
- Per §63-408.1, when an individual voluntarily quits a job without good cause, that
individuals FS application should be denied for 90 days from the date of the job
quit regardless of whether the job quit was before or after the FS application was made.
