Proposed Decisions for DHS

Judges are reminded that when they write a proposed decision (PD) for DHS, they should submit the PD to the Presiding Judge at least ten days prior to the adopt date. Per Welfare and Institutions Code (W&IC) §10959, the DHS actually has 30 days from the day it receives the PD to adopt or alternate the PD or to schedule a further hearing in the case. While DHS has 30 days to act on the PD, it has agreed that if decisions are submitted at least 10 days prior to the adopt date, it will act on the case by the adopt date.
