This Management Bulletin (MB)  provides updated guidance  relating to the adult day care component of the Child and Adult Care Food  Program (CACFP). Congress issued guidance relating to adult day care  immediately following the addition of the adult day care component to CACFP. Since  that time, the U.S. Department of Agriculture (USDA) has incorporated much of  the guidance into the CACFP regulations, thereby making the USDA memoranda  obsolete. In addition, the USDA has changed some regulations related to adult day  care agencies that are not reflected in previous guidance from USDA.
Background
	The adult day care component  of the CACFP was authorized by the Older Americans Act Amendments of 1987 and  codified in Title 7, Code of Federal Regulations, Section 226.19(a).
Rescinding U.S. Department of Agriculture Policies
The following memoranda are  rescinded because they include guidance that the USDA has codified in  regulation or instruction:

Additionally, USDA Child Care  Food Program Adult Day Care Provisions Operational Memorandum 2—Participation  of Institutionalized Adults, March 15, 1989 was superseded by Operational  Memorandum 2, Revision 1—Institutionalized Adults, September 15, 1989:
The remaining previous USDA  memoranda related to the adult day care component of CACFP were consolidated,  updated, and clarified by the following two memoranda:
	- Participant  Eligibility in the Adult Day Care Component of the Child and Adult Care Food  Program, August 7, 2012
 
	- Center  Eligibility and Licensing/Approval in the Adult Day Care Component of the Child  and Adult Care Food Program, August 7, 2012
 
	The CDE has issued USDA-CACFP-19-2012 and  USDA-CACFP-22-2012 to address the guidance in the above two new USDA policy  memos. These MBs may be viewed on the Child and Adult Care Food Programs Bulletins.
