AB 2827 Outdoor Activity Inclusion Workgroup

Assembly bill (AB) 2827, Chapter 916, Statutes of 2022 grants the California Department of Social Services (CDSS) the authority to implement the Interim Licensing Standards (ILS) until regulations are adopted. The ILS are intended to support inclusive outdoor play by allowing children with exceptional needs to use outdoor activity spaces at the same time as typically developing children. 

To support the implementation of AB 2827, CDSS, through its Community Care Licensing Division (CCLD), convened the AB 2827 Outdoor Activity Inclusion Workgroup. The workgroup’s role is to review the draft ILS and provide feedback, insights, and recommendations that will help directly inform the development of the ILS and support the advancement of those standards through the formal regulatory process.

Summary

AB 2827, Chapter 916, Statutes of 2022 directs CDSS to revise its child care licensing regulations to permit children with exceptional needs, as defined in Education Code section 8205, who are enrolled in separate programs or classrooms to use outdoor activity spaces simultaneously with typically developing children without requiring a regulatory waiver.

The law aims to promote inclusive participation in outdoor activities while ensuring appropriate health and safety protections for all children in licensed care settings.

In implementing AB 2827, the CCLD will convene the workgroup to review and provide feedback on the development of ILS. The workgroup will engage a range of participants, including child care providers, parent advocates, disability advocacy organizations, special education professionals, and relevant state and local partners.
