In compliance with the California Court of Appeal case of Latino Coalition for a Healthy California v. Belshé, counties are instructed not to apply ACWDL 97-06 which stated that possession of a Border Crossing Card or a temporary (B1/B2 visa) is conclusive evidence that the holder of the card or visa is not a California resident for Medi-Cal purposes. Counties must treat Medi-Cal applicants or recipients with Border Crossing cards or temporary visas the same as any other Medi-Cal applicant or recipient in determining California residency.
